Credit Card Information
AntiGravity does not take, collect or store your credit card information. All credit card transactions are done through PayPal via a secure SSL connection, and are subject to PayPal policies.
Product Liability Statement
Beyond the replacement of defective parts, as outlined in the returns policy, AntiGravity makes no warranty of any kind, expressed or implied and any implied warranty of merchantability or fitness for a particular purpose is hereby disclaimed entirely by AntiGravity. AntiGravity shall not be liable for any consequential or incidental damages, injury, loss or expenses arising from the use or inability to use the products we sell for any purposes whatsoever, or for any willful or accidental misuse of the products. By purchasing these products, the consumer acknowledges that these products are intended for specific educational and recreational purposes and that adult supervision, caution and reasonable care should be exercised in their use.
Unacceptable uses include but are not limited to, launching the product into the flight path of aircraft, launching the product toward people or vehicles, or using the product to create an explosive device or using the product in any way which may cause injury to self or others. The consumer agrees to release AntiGravity, it’s owners, employees, heirs, assigns, officers, agents and associates from any and all liability, claims, demands or actions or causes of actions arising from or blame whatever arising out of any damage, injury, loss or death resulting from any cause whatever, whether the result of misuse, the fault of the user, a defect in the product or from any other cause whatever, regardless of intention.
No action or representation written or verbal on the part of AntiGravity or any other can amend, make void, or alter this product liability limitation in any way at all. The consumer agrees to all of the terms of this limitation when purchasing or receiving goods from AntiGravity. If you do not agree to these terms, then do not use this website or buy or request or take receipt of products from AntiGravity.
DISCLAIMERS
AntiGravity explicitly states that it’s products are not meant for unsupervised children and are not meant for use with any air pump other than a standard low pressure bicycle pump, nor are they meant for use with any bottle other than a plastic bottle that previously contained fizzy pop. Using any air pump capable of applying more than 80 pounds per square inch of pressure or using anything other than a pop bottle is strongly DISCOURAGED. AntiGravity’s products are not to be used to over-pressurize or explode pop bottles. If you choose to do something unadvised with our products, we will not accept any responsibility whatever for your folly, malice or neglect.
Our receipt of your order does not constitute acceptance of your order or confirmation of an offer to sell. AntiGravity reserves the right to refuse services to any customer or limit quantity on any item. Verification of identity may be required before order acceptance. By ordering from us you warrant that you are at least 18 years of age and agree to be financially responsible for all orders you place from AntiGravity.
JURISDICTION
AntiGravity controls and operates this Site from Chilliwack in the province of British Columbia, Canada and from no other location. AntiGravity makes no representation as to the suitability or availability of this Site in other locations. Those who access the Site do so at their own risk and are responsible for compliance with local law.
The laws of the province of British Columbia shall govern this Site, these terms and conditions and any dispute related thereto without regard to choice of law rules. You hereby consent and agree to exclusive jurisdiction and venue of courts in New Westminster, British Columbia, Canada. Use of this Site is unauthorized in any
jurisdiction that does not give
effect to all of these terms including, without limitation, this paragraph.
INDEMNIFICATION
You agree to indemnify, hold harmless and defend AntiGravity from any claims and expenses including attorney fees and AntiGravity’s damages, actions or negligence arising in connection with a violation of this agreement by you or through the use of this Site or products.
You agree to indemnify, defend and hold harmless AntiGravity, any and all entities and persons associated in any way with this Site from any injury or liability or damages whatever arising from proper or improper use of products or from any damages, injury or death resulting from use or misuse of the products in any way whatever. If you do not agree, do NOT purchase products from us.
SEVERABILTY
If any part of this agreement is deemed to be invalid or unenforceable for any reason, then such invalid or unenforceable provision shall be deemed superceded by a valid and enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall remain in effect.
Product Returns
AntiGravity warrants its product against defects in materials and/or workmanship for a period of 30 days after the original puchase date, and will replace any part returned to our facility within this time and determined to be defective. AntiGravity does not warranty lost parts or parts that are damaged or worn out from use. If you are simply not happy with your purchase you may return it within the 30 day period for a full refund of the purchase price. All refunds will be credited to the credit card originally used for the purchase. Shipping charges will not be refunded. All items being returned must be in their original condition. AntiGravity will make every effort to process your refund quickly and you will be notified of your refund by e-mail.
